Fabian Martens is Partner and a member of the Competition & Trade group at Pestalozzi. As a competition law and antitrust lawyer in Switzerland, he has profound experience both in Swiss and EU competition law and a strong background in competition economics. In addition, Fabian has extensive expertise in public procurement law and represents bidders and contracting authorities at the federal and cantonal level.
Fabian advises on all aspects of competition law, including cartels and horizontal cooperations, vertical restraints and distribution agreements, abuse of dominance and relative market power as well as merger control. He represents clients before competition authorities and all Swiss public and civil courts, including in dawn raids, antitrust investigations or competition litigation.
Fabian advises clients across a wide range of industries, including automotive, manufacturing, consumer goods, retail and distribution, technology and digital markets, life sciences, and energy. In 2021, Fabian was awarded the Lexology Client Choice Award in Competition Law for Switzerland.
Fabian worked in competition teams of major international and Swiss law firms and has in-house experience. After graduating from the University of Zurich (cum laude), he obtained two LL.M. degrees from the New York University and the National University of Singapore (Dean’s Award Scholarship). He further holds a Master degree in Economics for Competition Law from King’s College, London (with merit). Fabian regularly publishes in the field of competition law and lectures at universities in Switzerland and abroad (Yale).
