Uncertain times – Terminations, Mass Dismissal, Social Plan, Mutual Termination Agreements: Swiss Employment Law and Standards

Martin L. Mueller, partner and head of the Employment team at Pestalozzi, will discuss whether given the current landscape, employers analyze even more carefully if they allocate resources correctly. Some employer will have to take corrective action and transfer positions to other sites of the Group in Switzerland or abroad or even let people go.

Swiss law is quite employer-friendly in such restructurings, especially compared to the regulations in other European countries. The law therefore only provides relatively rudimentary requirements. For example, the law does not provide for severance pay. However, employees usually have much more far-reaching expectations as to what the employer must provide in such a situation. Employees often argue that other companies offer much better benefits, e.g. by extending the notice period by one year with full time garden leave, followed by 18 months' severance pay... And that the employer should replicate this standard.
