Pre-worded terms and conditions are the preferred option for the conclusion of consumer agreements, in particular on online-platforms.

Since the revision of article 8 of the Federal Act against Unfair Competition in 2012, such terms and conditions are deemed unfair and invalid if they provide for a relevant and unjustified discrepancy between the contractual rights and the contractual obligations to the detriment of consumers and in violation of the principle of good faith. As a consequence, the drafting of general terms and conditions has become most demanding and legal uncertainty a constant issue for companies.
 
We would like to cordially invite you to discuss the major risks and pitfalls related to the drafting and using of general terms and conditions, in particular for e-commerce activities, and to review precedents and expert opinions.
 
Dr. iur. David Rüetschi, MJur (Oxon), Head of Civil Law and Civil Procedure Department at the Federal Office of Justice, will introduce topical issues from the use of potentially abusive terms and conditions.

A round-table discussion with case studies will follow.
