Pestalozzi represented the Republic of India in a landmark case before the Swiss Federal Supreme Court
The Republic of India filed a motion to the Swiss Federal Supreme Court to set aside a Interim award on jurisdiction in favor of Deutsche Telekom in an UNCITRAL investment arbitration proceeding. The main issue in the case was whether indirect investments fall under the scope of the 1995 Germany-India Bilateral Investment Treaty. The Swiss Federal Supreme Court deliberated this landmark case in a public hearing. Public hearings are extremely rare in the practice of the Swiss Federal Supreme Court; they take place only if the judges disagree or if issues of public importance are concerned.
