Thomas Rohner interviewed by Swiss National Radio on arbitration clauses
Pestalozzi Partner Thomas Rohner was interviewed by Swiss National Radio ("SRF", Echo der Zeit) regarding the decision of the Court of Justice of the European Union ("CJEU") in the matter of Slovak Republic v. Achmea BV. The CJEU ruled on 6 March 2018 that an arbitration clause contained in a bilateral investment treaty ("BIT") between EU member states is incompatible with EU law.
