AI and Liability – Established Rules or New Approaches?
On Monday, March 23, 2026, Markus Winkler will speak in Zurich at the second AI Symposium organized by LAWSTYLE on the topic “AI and Liability: Established Rules or New Approaches?”
The lecture provides a practice-oriented overview of how artificial intelligence fits into the existing Swiss liability framework. It examines how AI systems interact with the general tort regime under Art. 41 et seq. CO and product liability law and discusses whether these traditional concepts are sufficient to address AI-related risks.
The presentation will also highlight alternative approaches, including reliance-based liability and the role of judicial legal development, and will outline practical liability scenarios arising from the deployment of AI systems.
